5-20 4- PAYMENT OF STATE FUNDS TO COUNTIES.

(A)   CERTIFICATION OF AMOUNT OF STATE SHARE DUE.

TEN DAYS BEFORE THE END OF JULY, SEPTEMBER, NOVEMBER,
JANUARY, MARCH, AND MAY, THE STATE SUPERINTENDENT SHALL
CERTIFY TO THE STATE COMPTROLLER THE AMOUNT DUE AT THE END
OF EACH OF THESE MONTHS TO EACH COUNTY BOARD FOR THE ANNUAL
STATE SHARE OF BASIC CURRENT EXPENSES AS PROVIDED UNDER
§5-202 OF THIS SUBTITLE.

(B)   COMPTROLLER TO DRAW WARRANT.

WITHIN 5 DAYS BEFORE THE END OF EACH OF THESE MONTHS,
THE STATE COMPTROLLER SHALL DRAW HIS WARRANT ON THE STATE
TREASURER FOR THE AMOUNT DUE TO BALTIMORE CITY AND THE
TREASURER OF EACH COUNTY BOARD.

(C)   STATE TREASURER TO PAY STATE SHARE.

ON RECEIPT OF THE WARRANT OF THE STATE COMPTROLLER, THE
STATE TREASURER IMMEDIATELY SHALL PAY THE AMOUNT DUE TO
BALTIMORE CITY AND THE TREASURER OF EACH COUNTY BOARD.

REVISOR'S NOTE: This section presently appears as Art.
77, §127.

In subsections (a) and (b) of this section, new
language is added to indicate clearly that the
dates referred to in the statute are the last day
of each respective month. This Mas the apparent
statutory intent.

In subsection (a) of this section, the present
term "Board of School Commissioners of Baltimore
City" is deleted as unnecessary in light of the
definition of "county board" in §1—101 of this
article.

The only other changes are in style.

5-205. WITHHOLDING FUNDS.

AFTER NOTIFICATION FROM THE STATE SUPERINTENDENT THAT A
COUNTY IS NOT COMPLYING WITH THE PROVISIONS OF THE STATE
PROGRAM OF PUBLIC EDUCATION, THE STATE COMPTROLLER SHALL
WITHHOLD ANY INSTALLMENT DUE THE COUNTY FROM THE GENERAL
STATE SCHOOL FUND.

In this section, the present references to "City
of Baltimore" are deleted as unnecessary in light
