AN ACT concerning

Employment — Medical Questions

FOR the purpose of prohibiting employers from asking certain
requiring an applicant to answer any questions
concerning certain physical condition, psychological,
or psychiatric conditions or treatment of an the
applicant.

BY repealing and reenacting, with amendments,

Article 100 - Work, Labor and Employment

Section 95A(a)

Annotated Code of Maryland

(1964 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 100 - Work, Labor and Employment

95A.

(a) An employer may not ask an applicant any

question, written or oral, pertaining to any PHYSICAL,

psychiatric, or psychological condition REQUIRE AN APPLICANT
TO ANSWER ANY QUESTIONS, WRITTEN OR ORAL, PERTAINING TO ANY
PHYSICAL, PSYCHOLOGICAL, OR PSYCHIATRIC ILLNESS, DISABILITY,
HANDICAP or treatment which does not bear a direct,
material, and timely relationship to the applicant's fitness
or capacity to properly perform the activities or
responsibilities of the desired position.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

Municipal Elections — Voter Registration Purge

FOR the purpose of providing that voting in a municipal
election shall prevent the purging of a voter's
registration under certain conditions.
