SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section (s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

ARTICLE 49D - OFFICE FOR CHILDREN AND YOUTH

(A)    THE OFFICE FOR CHILDREN AND YOUTH IS CREATED AS
PART OF THE EXECUTIVE DEPARTMENT. THE OFFICE CONSISTS OF A
DIRECTOR, THE ADVISORY COMMITTEE FOR CHILDREN AND YOUTH, AND
THE CHILDREN'S COUNCILS.

(B)    THE DIRECTOR FOR CHILDREN AND YOUTH IS APPOINTED
BY AND SERVES AT THE PLEASURE OF THE GOVERNOR AND IS
DIRECTLY RESPONSIBLE TO HIM. THE DIRECTOR IS RESPONSIBLE
FOR THE OPERATION OF THE OFFICE AND SHALL ESTABLISH
GUIDELINES AND PROCEDURES TO PROMOTE THE ORDERLY AND
EFFICIENT ADMINISTRATION OF THE OFFICE. HE SHALL RECEIVE
THE SALARY PROVIDED IN THE STATE BUDGET.

(C)    THE OFFICE, ADVISORY COMMITTEE, AND CHILDREN'S
COUNCILS SHALL HAVE THE ASSISTANTS, CONSULTANTS, AND
EMPLOYEES PROVIDED IN THE STATE BUDGET.

2.

(A)    THE ADVISORY COMMITTEE IS A PART OF THE OFFICE
FOR CHILDREN AND YOUTH AND EXERCISES THE POWERS AND DUTIES
SPECIFIED IN THIS ARTICLE.

(B)    THE GOVERNOR SHALL APPOINT AN ADVISORY COMMITTEE
WHICH SHALL CONSIST OF:

(1) THE SECRETARY OF HEALTH AND MENTAL HYGIENE,
THE SECRETARY OF HUMAN RESOURCES, THE SUPERINTENDENT OF
EDUCATION OR THEIR DESIGNEES; AND

(1) (2) ONE REPRESENTATIVE FROM EACH
CHILDREN'S COUNCIL, A TOTAL OF 24; AND

(2) (3) 12 MEMBERS APPOINTED.

(C)    OF THE MEMBERS INITIALLY APPOINTED:

(1)    12 SHALL SERVE FOR A TERM OF ONE YEAR;

(2)    12 SHALL SERVE FOR A TERM OF TWO YEARS; AND

(3)    12 SHALL SERVE FOR A TERM OF THREE YEARS.

(D)    AFTER THE EXPIRATION OF THE INITIAL TERM, MEMBERS
ARE APPOINTED FOR A TERM OF THREE YEARS.

(E)    IN THE EVENT OF THE RESIGNATION OF A MEMBER OR A
VACANCY IN THE MEMBERSHIP OF THE ADVISORY COMMITTEE FOR ANY
