FOR the purpose of permitting the General Assembly to
authorize the restoration of certain stricken or
reduced appropriations involving the Transportation
Trust Fund under certain circumstances.
BY repealing and reenacting, with amendments,
Article — Transportation
Section 3-216 (d) (2)
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article — Transportation
3-216.
(d) (2) Expenditures under this subsection shall be
made in accordance with any appropriation provided for in
any applicable budget bill or supplementary appropriation
bill. However, an appropriation proposed to be made to any
unit in the Department or proposed to be made for any
designated transportation activity, function, or undertaking
that has been reduced by the General Assembly may not be
restored, for the same purpose as originally proposed, by
the budget amendment procedure of Article 15A, § 8 (e) of
the Code, UNLESS THE GENERAL ASSEMBLY IN STRIKING OR
REDUCING THE APPROPRIATION, EXPRESSLY AUTHORIZED ITS
RESTORATION VIA THE PROVISIONS OF ARTICLE 15A, SECTION 8(E).
SECTION 2. AND BE IT FURTHER ENACTED, That this Act is
hereby declared to be an emergency measure and necessary for
the immediate preservation of the public health and safety
and having been passed by a yea and nay vote supported by
three-fifths of all the members elected to each of the two
Houses of the General Assembly, the same shall take effect
from the date of its passage.
