be repealed, amended, or enacted to read as follows:
Article 78 - Public Service Commission Law
38A.
(A) In order to provide employees a reasonably safe
place to work, it shall be the duty of all persons, firms or
corporations engaged in the operation of railroads in this
State to keep and maintain those margins alongside their
yard tracks (except designated cleanout and repair tracks)
where such railroad employees are required to walk
frequently in the course of their duties, reasonably free
from debris and vegetation which unreasonably affects the
safety of such employees while working. This section shall
be enforced by the Commission upon complaint and after due
hearing; violations to be punishable by a fine of not less
than one hundred dollars ($100.00) nor more than five
hundred dollars ($500.00). Each day of noncompliance with
any order issued by the commission under the provisions of
this section shall be regarded as a separate violation.
(B) IF THE COMMISSION OR ITS AUTHORIZED AGENT FINDS
ANY CONDITION IN OR ON A YARD TRACK OR IN THE WALKWAY THAT
CONSTITUTES A AN IMMEDIATE DANGER TO THE HEALTH OR SAFETY
OF THE PUBLIC OR ANY RAILROAD EMPLOYEE, THAT YARD TRACK MAY
BE IMMEDIATELY CLOSED UNTIL THE SITUATION IS CORRECTED.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
