OWNER'S NEGLIGENCE IN CONNECTION WITH     THE PROVIDING AND

MAINTAINING OF TRAILS, STAIRS, ELECTRICAL      WIRES, OR OTHER

MODIFICATIONS, AND THE NEGLIGENCE IS THE   PROXIMATE CAUSE OF
THE INJURY.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning

Allegany County — Acquisition of Land in
Allegany County

FOR the purpose of providing that the State may not acquire
a tract of land of a certain size in Allegany County
without the approval of the County Commissioners; and
providing for a certain exception.

Section 5-910

Annotated Code of Maryland

(1974 Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article — Natural Resources

5-910.

THE STATE MAY NOT ACQUIRE A TRACT OF LAND IN ALLEGANY
COUNTY OF OVER 100 ACRES FOR PRESERVATION OF OPEN SPACES AND
AREAS UNLESS THE COUNTY COMMISSIONERS OF ALLEGANY COUNTY

APPROVE THE PURCHASE. THIS REQUIREMENT DOES__NOT APPLY__TO

OPEN SPACE AND OUTDOOR RECREATION AREAS WHICH HAVE

PREVIOUSLY BEEN AUTHORIZED FOR ACQUISITION BY THE

LEGISLATURE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
