BLAIR LEE III, Acting Governor                        1421

OF THE COUNTY IN WHICH THE MINOR IS CONFINED, OR IN THE
SUPREME BENCH OF BALTIMORE CITY, IF THE MINOR IS CONFINED IN
A FACILITY IN BALTIMORE CITY.

            (2) UPON FINDING A FAILURE TO COMPLY WITH

SUBSECTION (A) THE COURT SHALL ORDER THE FACILITY TO COMPLY

WITH THE PROVISIONS OF THAT SECTION. IF THE COURT FINDS

THAT THE FACILITY IS UNABLE TO COMPLY WITH THE PROVISIONS OF

SUBSECTION (a) OF THIS SECTION, IT SHALL ORDER THE IMMEDIATE

UNCONDITIONAL RELEASE OF THE MINOR OR IMMEDIATE TRANSFER OF

REQUIREMENTS OF SUBSECTION (A) OF THIS SECTION AND

PROVIDING THE TREATMENT AND CARE WHICH WILL-----ACCOMPLISH THE

PURPOSE FOR WHICH THE MINOR WAS ORIGINALLY ADMITTED,

COMMITTED, OR CONFINED.

(3) ALL COSTS OF PLACING AND MAINTAINING A

MINOR IN A PRIVATE FACILITY SHALL BE PAID BY THE STATE TO

THE EXTENT THESE COSTS EXCEED THE AMOUNT THAT WOULD

OTHERWISE BE PAID BY PERSONS LEGALLY RESPONSIBLE FOR THE

COST OF MENTAL HEALTH SERVICES THAT WOULD BE PROVIDED IN A

PUBLIC FACILITY.

(C) THE GOVERNOR SHALL ANNUALLY INCLUDE IN THE--STATE

BUDGET AN AMOUNT NECESSARY TO ENABLE THE STATE TO COMPLY

WITH THE PROVISIONS OF THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978 January 1, 1979.

FOR the purpose of designating certain moneys levied and
collected under the farm product certification
subtitle, as the Commodity Quality Grading Fund; and
specifying that unexpended moneys in the Fund do not
revert to the general funds of the State.
