BLAIR LEE III, Acting Governor                           1403

State-sponsored agency or any group recognized by the
Maryland Commission on Aging, of special pricing and/or
services, without identifying individual prescription drug
items, to residents of the State of Maryland who have
attained 60 years of age, shall not constitute
unprofessional conduct within the meaning of this subtitle.

(v) The advertising or claiming to the
public of professional superiority in the compounding or
filling of prescriptions or in any manner implying
professional superiority which may undermine public
confidence in the ability, character and integrity of other
pharmacists.]

(C) (1) THE BOARD MAY WITHHOLD, DENY, SUSPEND,
REVOKE, OR REFUSE TO RENEW THE LICENSE OF ANY PHARMACIST OR
ISSUE A REPRIMAND FOR ANY OF THE FOLLOWING CAUSES:

(I)    CONVICTION OF A CRIME INVOLVING MORAL
TURPITUDE;

(II)   CONVICTION OF A CRIME INVOLVING
PROFESSIONAL MISCONDUCT RESPECTING THE PHARMACY LAWS OF THIS
OR ANY OTHER STATE;

(III)   FRAUDULENT OR DECEITFUL PROCUREMENT
OR USE OF A PHARMACIST'S CERTIFICATE OF RENEWAL;

(IV)   ISSUANCE, PUBLICATION, BROADCAST,
DISTRIBUTION OR ANY ADVERTISING THAT TENDS TO DECEIVE OR TO
DEFRAUD THE PUBLIC;

(V)    AGREEMENT WITH AN AUTHORIZED
PRACTITIONER FOR THE COMPOUNDING OR DISPENSING OF SECRET
(CODED) FORMULA PRESCRIPTION;

(VI)   DIVISION OF ANY FEE OR AGREEMENT TO
SPLIT OR DIVIDE ANY FEE RECEIVED FOR PROFESSIONAL SERVICES
WITH AN AUTHORIZED PRESCRIBER;

(VII)  DISPENSING OR SALE OF ANY DRUG FOR
WHICH A PRESCRIPTION IS REQUIRED WITHOUT FIRST HAVING
RECEIVED FROM AN AUTHORIZED PRESCRIBER A WRITTEN OR ORAL
PRESCRIPTION FOR THE DRUG;

(VIII)   REFILLING OF A PRESCRIPTION FOR ANY
DRUG FOR WHICH A PRESCRIPTION IS REQUIRED BY THE LAWS OF
THIS STATE, UNLESS THE PRESCRIBER AUTHORIZES THE REFILLING
IN THE ORIGINAL PRESCRIPTION OR BY ORAL ORDER;

(IX)   PROVISION OR CAUSING THE PROVISION OF
PRESCRIPTION BLANKS OR FORMS THAT BEAR THE PHARMACIST'S OR
PHARMACY'S NAME, ADDRESS OR OTHER MEANS OF IDENTIFICATION TO
AN AUTHORIZED PRACTITIONER;

(X)    ASSOCIATION BY THE PHARMACIST, AS A
PARTNER, COOWNER, OR EMPLOYEE OF A PHARMACY, THAT AN
AUTHORIZED PRESCRIBER OR GROUP OF PRESCRIBERS WHOLLY OR
