38.

(b) It shall not be lawful IS UNLAWFUL for any person
or persons or body corporate to sell directly or indirectly
at any place within the corporate limits of the Town of
Hyattsville, or to give away at any place of business
therein, any alcoholic beverages or any intoxicating drinks
of any kind other than beer, light wine and on—sale liquor,
said liquor being only for consumption on the immediate
premises of a Class B license[. The board of license
commissioners for Prince George's County shall not approve
the application for any license, and the clerk shall not
issue any license, for the sale of any alcoholic beverages
or intoxicating drinks of any kind, within the limits of the
Town of Hyattsville, other than beer, light wine and on—sale
liquor, said liquor being only for consumption on the
immediate premises of a Class B license.], EXCEPT THAT THE
BOARD OF LICENSE COMMISSIONERS FOR PRINCE GEORGE'S COUNTY
MAY APPROVE THE TRANSFER OF ONE CLASS B BEER, WINE AND
LIQUOR LICENSE WITH AN OFF-SALE PRIVILEGE, AS DEFINED IN
SUBSECTION 19(I) OF THIS ARTICLE, FOR USE WITHIN THE

CORPORATE LIMITS OF THE CITY OF HYATTSVILLE. THE LICENSEE

SHALL PAY AN ANNUAL FEE OF $1,500 FOR THIS CLASS B BEER,

WINE AND LIQUOR LICENSE WITH AN OFF SALE PRIVILEGE, FOR

WHICH THE LICENSEE PAYS AN ANNUAL FEE OF $1,500.

SECTION 2. AND BE IT FURTHER ENACTED,     That this Act

shall take effect July 1, 1978. is declared to be an

emergency measure and necessary for the immediate

preservation of the public health and safety   and having been

passed by a yea and nay vote supported by   three—fifths of

all the members elected to each of the two Houses of the

General Assembly, it shall take effect from   the date of its

passage.
