and Term of Office

FOR the purpose of clarifying the law relating to the
appointment and terms of office of county
superintendents of schools; requiring a county board of
education to appoint at a certain time a county
superintendent for a term that is to begin on a certain
date; providing for the appointment of an interim
county superintendent; and generally relating to county
superintendents of schools.

BY repealing and reenacting, with amendments,

Article — Education
Section 4-201(b) and (d)
Annotated Code of Maryland

(As enacted by Chapter ____ of the Acts

of the General Assembly of 1978)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ____ of the Acts of the General

Assembly of 1978) be repealed, amended, or enacted to read
as follows:

Article - Education

4-201.

(b) (1) [Each] IN FEBRUARY OF THE YEAR IN WHICH THE
TERM OF A COUNTY SUPERINTENDENT IS TO END, THE county board
shall appoint a county superintendent [in February] TO SERVE
for a term of 4 years beginning on July 1 after his
appointment.

(2) A county superintendent holds office until
a successor is appointed and qualifies.

(d) f (1) The county board shall appoint an
individual to fill a vacancy in the office of county
superintendent.

(2) An individual appointed to fill a vacancy
serves for a full term of 4 years and until a successor is
appointed and qualifies.]

IF A VACANCY OCCURS IN THE OFFICE OF COUNTY
SUPERINTENDENT:

(1)    THE COUNTY BOARD SHALL APPOINT AN INTERIM
COUNTY SUPERINTENDENT WHO SERVES UNTIL JULY 1 AFTER HIS
APPOINTMENT; AND

(2)    IF AN INTERIM COUNTY SUPERINTENDENT IS
APPOINTED, THE COUNTY BOARD SHALL APPOINT A COUNTY
SUPERINTENDENT WHO BEGINS HIS TERM ON JULY 1 AFTER HIS
APPOINTMENT FOR A 4-YEAR TERM AND THE COUNTY SUPERINTENDENT
