CHAPTER 250

(Senate Bill 559)

AN ACT concerning

Crimes — Motor Vehicle Devices

FOR the purpose of prohibiting a person from possessing
certain devices which may be used to unlawfully
operate, open, tamper, break and enter a motor vehicle;
clarifying certain language; and generally relating to
unlawful possession of certain devices for use on motor
vehicles.

BY repealing and reenacting, with amendments,

Article 27 — Crimes and Punishments

Section 349A and 490

Annotated Code of Maryland

(1976 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND,, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 — Crimes and Punishments

349A.

(A) [No] A person, except a person while making

lawful use of them in pursuit of a legitimate business
interest or a law enforcement officer while in pursuit of
his duties, [shall] MAY NOT at any time have or possess a
motor vehicle master key adapted for or capable of being
used to open or operate any motor vehicle in this State.

(B) A PERSON MAY NOT POSSESS A PICKLOCK, KEY, CROW,

JACK, BIT OR OTHER DEVICE AT PLACES AND UNDER CIRCUMSTANCES

FROM WHICH AN INTENT MAY BE PRESUMED TO UNLAWFULLY BREAK AND
ENTER, TAMPER, OPEN OR OPERATE ANY MOTOR VEHICLE IN THIS

STATE.

    

      (C) Any person who violates the provisions of this

section, [shall be] IS guilty of a misdemeanor and [upon
conviction] shall be fined not more than [five hundred

dollars ($500) and/or-shall be] $500 OR imprisoned for not

more than one [(1)] year, OR BOTH.
