(3)    ANY PETITION BY RESIDENTS OF THE COUNTY
SHALL BE FILED AT THE OFFICE OF THE COUNTY BOARD WITHIN 15
DAYS AFTER THE BOARD GIVES PRELIMINARY APPROVAL OF THE SITE.

(4)    IF A HEARING IS HELD, MINUTES SHALL BE KEPT
AND, AFTER DELIBERATION, THE COUNTY BOARD SHALL SEND THE
MINUTES OF THE HEARING AND ITS RECOMMENDATION TO THE STATE
SUPERINTENDENT FOR USE IN MAKING A DECISION ON HIS APPROVAL
OF THE SITE.

(5)    A REQUEST FOR SITE APPROVAL MAY NOT BE MADE
TO THE STATE SUPERINTENDENT BY A COUNTY BOARD UNTIL 15 DAYS
PASS AFTER ITS ACTION RECOMMENDING THE SITE OR, IF A HEARING
IS HELD, UNTIL AFTER A THE HEARING IS HELD, WHICHEVER OCCURS
LAST.

REVISOR'S NOTE: This section presently appears as Art.
77, §47(b).

Subsection (a) of this section is new language
derived from the exception in present Art. 77,
§56D(a).

The only other changes are in style.

4-116. CONSTRUCTION AND REMODELING OF BUILDINGS.

(A)   BALTIMORE CITY EXCEPTED.

THIS SECTION DOES NOT APPLY TO BALTIMORE CITY.

(B)   ARCHITECTS.

ON THE RECOMMENDATION OF THE COUNTY SUPERINTENDENT, A
COUNTY BOARD MAY EMPLOY ARCHITECTS TO ASSIST IN PREPARING
PLANS AND SPECIFICATIONS FOR CONSTRUCTING OR REMODELING A
BUILDING.

(C)       BUILDING REGULATIONS.

THE CONSTRUCTION OR REMODELING OF A BUILDING SHALL
CONFORM TO ALL APPLICABLE STATE AND LOCAL COUNTY BUILDING,
ELECTRICAL, FIRE, AND PLUMBING REGULATIONS AND CODES.

REVISOR'S NOTE: This section presently appears as Art.
77, §47(c) and (d).

Subsection (a) of this section is new language
derived from the exception in present Art. 77,
§56D(a).

In subsection (b) of this section, the word
"county" is added before "superintendent" since
this is the apparent statutory intent.
