special taxing area DISTRICT an amount equivalent to 8.5
percent of the State income tax liability of the residents
of such incorporated municipality or special taxing area
DISTRICT, except that the same shall not be certified nor
paid by the Comptroller to any incorporated municipality or
special taxing area DISTRICT which has not levied, or if the
same shall not be levied for it, in its current fiscal year,
taxes sufficient to collect a minimum of one dollar per
capita of revenue and it shall have certified a copy of said
levy to the State Comptroller. THE COMPTROLLER SHALL NOT

CERTIFY NOR PAY TO A SPECIAL TAXING AREA TREATED AS A

MUNICIPALITY, IN EXISTENCE BEFORE JULY 1, 1977 AN AMOUNT OF

TAX IN FISCAL YEAR 1979 AND IN EACH FISCAL YEAR THEREAFTER

THAT EXCEEDS THE AMOUNT CERTIFIED AND PAID TO SUCH SPECIAL

TAXING AREA IN FISCAL YEAR 1978. Per capita revenue shall

be computed for purposes of this section by using the
population figures furnished by the latest federal census or
by an official local census, whichever is latest.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
