Clerk shall retain 1 percent of the tax so collected.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect June 1, 1978.

AN ACT concerning

Industrial Land Act — Railroad Property

FOR the purpose of authorizing and providing for loans under
the Maryland Industrial Land Act for certain
acquisitions of railroad property and rights-of-way by
a political subdivision.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

(G) A LOAN MAY BE MADE UNDER THIS SECTION TO ACQUIRE
RAILROAD PROPERTY OR RIGHTS-OF-WAY, UP TO 100 PERCENT OF THE
COST OF ACQUISITION. THE CONTENTS OF THE APPLICATION SET
FORTH IN SUBSECTION (A) AND THE FACTORS TO BE CONSIDERED BY
THE SECRETARY SET FORTH IN SUBSECTION (B) SHALL BE
APPLICABLE TO RAILROAD PROPERTY OR RIGHTS-OF-WAY,
PARTICULARLY THE NEED FOR RAIL SERVICE TO SUPPORT EXISTING
OR POTENTIAL INDUSTRY, COMMERCE, OR AGRICULTURE, AND THE
NEED FOR ACQUISITION TO AVOID THE EFFECTS OF DISCONTINUANCE
OF SERVICE OR ABANDONMENT OF RAILROAD USE. REFERENCES TO
LAND SHALL, FOR THE PURPOSES OF THIS SUBSECTION, REFER TO
THE RAILROAD PROPERTY OR RIGHTS-OF-WAY TO BE ACQUIRED.
