MARVIN MANDEL, Governor
which provides for hearings on refusal, suspension, or
revocation of a license, as already covered by the
standard provisions of §15—110 of this title. Similarly, as detailed in various of the revisor's
notes in this subtitle, the substance of several other
provisions of present Art. 66 1/2, Subtitle 6, Part V
("Drivers' Schools") have been incorporated in the
standard, general provisions of Subtitle 1 of this title
and do not require repetition in this subtitle. See,
also, General Revisor's Note to Subtitle 1 of this title.
SUBTITLE 8. DRIVING INSTRUCTORS.
15-801. DEFINITIONS. (A)       IN GENERAL. IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS INDICATED. REVISOR'S NOTE: This subsection is new language used
as the standard introductory language to a
definition section. (B)       DRIVING INSTRUCTOR. "DRIVING INSTRUCTOR" MEANS ANY INDIVIDUAL WHO: (1)         FOR COMPENSATION, UNDER ANY FORM OF
AGREEMENT OR ARRANGEMENT WITH A DRIVERS' SCHOOL, GIVES OR
OFFERS TO GIVE INSTRUCTION IN THE DRIVING OF MOTOR
VEHICLES; OR (2)          UNLESS HE IS ACTING AS AN EMPLOYEE OF AN
EDUCATIONAL INSTITUTION DESCRIBED IN § 15-701(B)(2) OF
THIS TITLE, OTHERWISE GIVES OR OFFERS TO GIVE ANY OTHER
INDIVIDUAL INSTRUCTION IN THE DRIVING OF MOTOR VEHICLES
AND RECEIVES OR EXPECTS TO RECEIVE COMPENSATION FOR THAT
INSTRUCTION. REVISOR'S NOTE: This section is new language added
to clarify, in conformity with current
regulations and practice, the distinction
between a drivers' school, which is required
to be licensed under Subtitle 7 of this title,
and a driving instructor. Derived in. part from the first sentence of
present Art. 66 1/2, §6-507(a) and patterned
after the definition of "vehicle salesman" in
§15—101 of this title, this definition - when
read in conjunction with Subtitle 7 and the
balance of this subtitle - clarifies the
intent that: (i) if, for compensation, an
individual instructs others in driving, he
first must be licensed as a driving instructor
