VIOLATION OR OTHER CAUSE, AS PERMITTED BY THIS TITLE,
THAT OCCURRED DURING THE 2 LICENSE YEARS IMMEDIATELY
PRECEDING THE RENEWAL.
REVISOR'S NOTE: This section is new language that
combines Art. 66 1/2, §§ 6-503 and 6-504.
Present Art. 66 1/2, §6-503 lists the grounds
for refusal of an application for a license,
while present Art. 66 1/2, §6-504 states the
grounds for suspension, revocation, or refusal
to renew a license. However, since these two
sections overlap in part and since present
§6-504(a) (2) effectively incorporates all of
§6—503, the two sections can be incorporated
in one section, as here, without substantive
effect.
In subsection (a)(4) of this section, the
present phrase "but is not limited to" is
deleted as unnecessary in light of the
definition of "including" in §1-101 of this
article. Also, the present references to
"fraudulent practices" are deleted as covered
by the equally broad, if not broader, "any
fraud".
Subsection (a) (5) of this section is new
language derived from the first sentence of
present Art. 66 1/2, §6-706. As to the
referenced "Maryland Driver Education Program"
- and the balance of present §6—706 - see
Title 16, Subtitle 5 of this article.
Present Art. 66 1/2, §6-503(3), which
provides for refusal of a license if the
applicant "does not have a place of business"
as required by this subtitle, is deleted as
unnecessary in light of §15-105 of this title
and its incorporation in §15-109 of this title
to the same effect.
Present Art. 66 1/2, §6-504(a)(2), which
provides for refusal, suspension, or
revocation on violation of the provisions of
this subtitle or its rules and regulations, is
deleted as already covered by the standard
provisions of §15-109 of this title.
The only other changes are in style.
See, also, §15-109 of this title.
