REVISOR'S NOTE: This subsection is new language
added as a modification, for purposes of this
title, of the basic, broader definition of
"dealer" in §11-111 of this article. Paragraph (1) of this subsection is derived
without substantive change from Art. 66 1/2,
§5-101(b). Paragraph (2) of this subsection is derived
from the "vehicle salesman" — exclusions
contained in present Art. 66 1/2, §1-210(b).
It is transferred here and revised for
clarification and to conform to current
practice; the persons described in present
§1—210(b) are exempt not only from the vehicle
salesman licensing laws of this title, but, by
clear implication, are exempt also from the
dealer licensing laws. In paragraph (2)(ii) of this subsection, the
reference to "other financial institution" is
added for clarity; the exception is intended
to apply to banks and other institutional
lenders as well as "finance" companies. In paragraph (2) (iii) of this subsection, the
reference to a "receiver, trustee, personal
representative, or other person" is added to
clarify the present, ambiguous reference to
sales or disposals of vehicles "under the
authority of any court". Paragraph (2) (iv) is revised to clarify its
intent to exempt only manufacturers,
distributors, and their employees, and not any
"persons" who sell to dealers. This
interpretation conforms to current practice. The only other changes are in style. (C) NEW CLASS A OR CLASS E VEHICLE. "NEW CLASS A VEHICLE" AND "NEW CLASS B VEHICLE" MEAN
A NEW VEHICLE THAT, IF LATER SOLD AND REGISTERED IN THIS
STATE, COULD BE REGISTERED EITHER AS A CLASS A
(PASSENGER) VEHICLE OR A CLASS B (FOR HIRE) VEHICLE, AS THE CASE MAY BE. REVISOR'S NOTE:. This subsection is new language
added to clarify present references to those
vehicles, particularly as these references
appear in Subtitle 2 of this title.
Technically, a "new vehicle", as defined in
§11—138 of this article, does not have a
classification since it is as yet
unregistered.
