"FARM VEHICLE" MEANS A VEHICLE THAT:
(1) IS OWNED BY A FARMER;
(2) IS USED ONLY IN THE FARMER'S FARMING
BUSINESS AND ABOUT THE FARMER'S FARM HOME AND IN HAULING
FARM PRODUCTS AND THE LABOR, SUPPLIES, EQUIPMENT, AND
OTHER MATERIALS NECESSARY FOR THE OPERATION OF THE FARM
AND FARM HOME; AND
(3) IS NOT USED TO HAUL FARM PRODUCTS
PREVIOUSLY ACQUIRED BY THE FARMER FOR RESALE OR TO HAUL
FARM PRODUCTS FOR OTHERS FOR HIRE.
REVISOR'S NOTE: This subsection is new language
derived from the second to last sentence of
Art. 66 1/2, §3—806(e) and, by implication,
the last sentence of §3-809(c).
Item (3) of this subsection is new language
derived from the last clause of Art. 66 1/2,
§3-808(c) and, by implication, §3-808(d)(3)
and (4). Although the last clause of present
§3-808(c) literally qualifies the definition
of "farmer", it clearly is more appropriate as
a qualification on the vehicle's use rather
than the general business of a farmer. (For
example, as §3—808(c) presently is worded, if
a farmer were engaged both in the activities
enumerated in subsection (b) of this section
and in hauling for hire, the farmer would be
precluded from registering a farm truck
tractor, even if that particular vehicle were
used exclusively in the permitted activities
of subsection (b), This result certainly was
never intended.)
Placement of the definition here provides a
uniform definition for this subtitle and
conforms to the interpretation used by the
Administration for all of this subtitle.
13-912. PASSENGER CARS AND STATION WAGONS: CLASS A
(PASSENGER) VEHICLES.
(A) CLASSIFICATION.
WHEN REGISTERED WITH THE ADMINISTRATION, EVERY
PASSENGER CAR AND STATION WAGON, EXCEPT AS OTHERWISE
PROVIDED IN THIS PART, IS A CLASS A (PASSENGER) VEHICLE.
(B) ANNUAL FEE.
FOR EACH CLASS A (PASSENGER) VEHICLE, THE ANNUAL
REGISTRATION FEE IS:
(1) FOR A VEHICLE WITH A MANUFACTURER'S
SHIPPING WEIGHT OF 3,700 POUNDS OR LESS - $20; AND
