consistency. Without this language, the
prohibition literally would apply only if a
request actually were made by the former owner
or the Administration, even though under
subsection (a) (2) of this section the
possessor is required to return the plates,
even absent a request, after completion of the
permitted operation; such a gap in the law
appears inconsistent and apparently was
unintended.
Also, subsection (a)(3) is revised to provide
for a 24—hour grace period within which to
dispose of the plates after the request is
made or the operation completed; in this
regard, see revisor's note to §13—501 of this
subtitle.
In subsection (b) of this section, the phrase
"and permit ... to be driven" is added for
clarity. Also, new language is added to
permit a "personal representative" to operate
the vehicle; this conforms to current practice
and clarifies the law as to who may operate
the vehicle before the distribution of the
estate and the transfer of title to the person
entitled to it. Also, the present phrase
"during the course of the administration of
the estate" is deleted to conform to the
policy of §5—608 of the Estates and Trusts
Article, which, in specified situations,
requires a new registration only on expiration
of the current registration in the name of the
deceased.
The only other changes are in style.
13-505. SCRAPPING, DISMANTLING, OR DESTROYING VEHICLES.
IF AN OWNER TRANSFERS HIS TITLE OR INTEREST IN A
VEHICLE THAT IS TO BE SCRAPPED, DISMANTLED, OR DESTROYED,
THE OWNER IMMEDIATELY SHALL MAIL OR DELIVER THE
REGISTRATION CARD AND REGISTRATION PLATES OF THE VEHICLE
TO THE ADMINISTRATION FOR CANCELLATION, UNLESS THE
REGISTRATION PLATES ARE TRANSFERRED TO ANOTHER VEHICLE
AS PROVIDED IN THIS SUBTITLE.
REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §3-505.
The phrase "transfers his title or interest"
is substituted for "sells or assigns his
interest" to conform to the usage appearing in
§13—501 and elsewhere in this subtitle.
The only other changes are in style.
