§1-171.
The term "fixed termini" is defined in §11-122
of this subtitle.
It is important to note that the definitions
of "fixed termini" and "regular schedule"
presently are incorporated by reference in
§32(a-1) of Article 78 of the Code, the Public
Service Commission Law, and that the terms are
used — although presently not expressly
defined — in §2(w) of that Article, which
defines "taxicab". See, also, Art. 56, §§
151B and 164, and Art. 81, §§ 326(g-2) and
425, of the Code.
In present Art. 66 1/2, the terms appeared in
but one section: present §3—811 contains the
phrase "regularly fixed {sic} schedule, and
between fixed termini" (see §13-931 of this
article).
However, in a few instances, present Art. 66
1/2 does use similar phraseology that, by
substitution of the defined terms, have been
conformed. Thus, in §11—165 of this subtitle,
which defines "taxicab", the phrase "operated
on regular schedules and between fixed
termini" is substituted for "operated ... on
fixed routes and schedules"; (see revisor's
note to that section); in §13-310 (a) (14) of
this article, as added recently by Ch. 896,
Acts of 1976, the phrase is substituted for
"in regular routes between fixed points" (see,
also, Art. 56, §§ 1513 and 184, and Art. 81,
§§ 326(g—2) and 425, of the Code); and, in
§13—913 of this article, the same phrase is
substituted for the present reference to
"fixed schedules". The changes are made for
clarity and consistency and appear to be
within the intent of the source law.
11-149. RESIDENT.
"RESIDENT" MEANS ANY PERSON:
(1) WHO IS A LEGAL RESIDENT OF THIS STATE;
(2) WHO OWNS, MAINTAINS, OR OPERATES A PLACE OF
BUSINESS IN THIS STATE AND USES MOTOR VEHICLES
INTRASTATE IN THAT BUSINESS IN THIS STATE;
(3) WHO MAINTAINS A TEMPORARY RESIDENCE IN THIS
STATE AND ACCEPTS ANY EMPLOYMENT OR ENGAGES IN ANY TRADE,
PROFESSION, OR OCCUPATION IN THIS STATE; OR
(4) WHO MAINTAINS A TEMPORARY OR SEASONAL RESIDENCE
IN THIS STATE IN EXCESS OF 120 CUMULATIVE DAYS CURING THE
