Article 59A — Mental Retardation
Section 8A
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 8A be and it is hereby added
to Article 59A - Mental Retardation, of the Annotated
Code of Maryland (1972 Replacement Volume and 1975
Supplement) to read as follows:
Article 59A - Mental Retardation
8A.
ON MARCH 1, 1977, EVERY INDIVIDUAL IN OR ADMITTED TO
ANY RESIDENTIAL FACILITY OPERATED OR LICENSED BY THE
MENTAL RETARDATION ADMINISTRATION SHALL HAVE AN
INDIVIDUALIZED PLAN OF CARE, INCLUDING TRAINING,
APPROPRIATE THERAPEUTIC PROGRAMS, AND RECREATIONAL
ACTIVITIES DEVELOPED FOR HIM IN WRITING BY PROFESSIONAL
AND SUPPORTIVE PERSONNEL AS PROVIDED FOR HEREIN. THE
INDIVIDUALIZED PLAN OF CARE SHALL BE REEVALUATED
PERIODICALLY.
[[THE DIRECTOR OF MENTAL RETARDATION SHALL ISSUE
APPROPRIATE DIRECTIVES TO CARRY OUT THE INTENT OF THIS
SECTION.]] THE DIRECTOR OF MENTAL RETARDATION IS
RESPONSIBLE FOR IMPLEMENTATION OF THESE PLANS SUBJECT TO
BUDGET APPROPRIATION AND SHALL ISSUE APPROPRIATE
DIRECTIVES TO CARRY OUT THE INTENT OF THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
Passed over the Governor's veto, in the House of
Delegates on January 12, 1977, and in the Senate on
January 13, 1977.
