In subsection (b) of this section, the present
statement that the vacancy is filled by
"appointment of the Governor" is deleted as
unnecessary in light of the express provisions
of §231P of this subtitle.
In subsection (c) of this section, the word
"person" is substituted for "firm,
corporation, partnership or association" since
"person", by definition in §231N of this
article, includes the deleted words. The
phrase, in (c)(2), "other than a using
authority", is added for clarity.
231R. RULES AND REGULATIONS.
(A) ADOPTION.
THE BOARD SHALL ADOPT RULES AND REGULATIONS TO CARRY
OUT THE PROVISIONS OF THIS SUBTITLE.
(B) SIMILARITY WITH THOSE OF GENERAL BOARD.
THE RULES AND REGULATIONS ADOPTED BY THE BOARD UNDER
THIS SECTION AND THOSE ADOPTED BY THE TRANSPORTATION
PROFESSIONAL SERVICES SELECTION BOARD UNDER §2-305 OF THE
TRANSPORTATION ARTICLE SHALL PROVIDE FOR SUBSTANTIALLY
THE SAME PROCEDURES.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 41, §231N
(d).
The present requirement that the rules and
regulations be adopted "{w}ithin 90 days after
the effective date of this act" is deleted as
obsolete.
231S. ADVISORY SERVICES OF BOARD.
ON REQUEST OF A SCHOOL BOARD OR POLITICAL
SUBDIVISION OF THIS STATE, THE BOARD MAY PROVIDE ADVISORY
SERVICES IN PROCURING ARCHITECTURAL AND ENGINEERING
SERVICES. THE SCHOOL BOARD OR POLITICAL SUBDIVISION
SHALL REIMBURSE THE BOARD FOR THE COSTS OF THESE
SERVICES.

§231P(d)(5).
The present references to a "municipality" and
"county" are deleted as unnecessary in light
of the broad reference to a "political
subdivision of this State".
