REVISOR'S NOTE: This section is new language derived
from Art. 41, §208D(d) and, as to the regional
members of the State Roads Commission, the
last sentence of the first paragraph of Art.
89B, §1.
In light of the passing reference in present
Art. 89b, §3(b) to "the function {of the
regional members of the State Roads
Commission} of giving advice and
recommendations to the ... Secretary of
Transportation", it appears appropriate to
integrate that advisory function - as further
detailed in those provisions of Art. 89B# §1
from which subsection (a)(2) of this section
is derived - with the like functions of the
Maryland Transportation Authority, of which
these regional members are members ex officio.
In light of subsection (b) of this section,
the reference in present Art. 89B, §3(b)
quoted above becomes redundant and
unnecessary. To the extent that present §3(b)
denies the State Highway
Administrator/Chairman of the State Roads
Commission the authority to exercise this
advisory function, it is similarly superfluous
since the Administrator/Chairman has no
jurisdiction over any of the functions of the
Maryland Transportation Commission.
This revision, therefore, avoids the
possibility of unnecesary duplication of
advisory efforts and, notwithstanding the
transfer of present Art. 89B provisions to
this section, in no way precludes the regional
members of the State Roads Commission from
reporting directly to the State Roads
Commission or advising the Chairman/State
Highway Administrator or the Secretary as a
body independent of the Maryland
Transportation Commission.
The only other changes are in style.
