repealing and re—enacting with amendments Section
2—108, title "Created; composition; interview;
appointment and term of members; disclosure of
interests", and Section 2-110, title "Qualifications
of members", to clarify provisions concerning
interviewing of applicants for the Board of Appeals
and appointments of members thereof, and to provide
that persons appointed to fill vacancies created
other than by the expiration of a term shall be of
the same political party as the members they
replace.

Chapter 46
AN ACT to amend Chapter 24, title "Health and
Sanitation", of the Montgomery County Code 1972,
as amended, to repeal in its entirety Article III
thereof, title "Comprehensive Health Planning",
and to enact a new Article III, title "Health
Systems Agency", consisting of Sections 24—22
through 24—45, to set forth legislative findings
and to state the purpose and intent of this Act;
specify definitions applicable to this new Article
III; to establish a Montgomery County Health
Systems Agency as a part of County government for
the purpose of implementing certain health
planning and development functions in the County;
to establish a Health Services Planning Board to
consist of twenty—three members to be appointed by
the County Executive, subject to confirmation by
the County Council; to specify the composition and
the manner of appointment of the Health Services
Planning Board; to specify the terms of office,
reappointment procedures, and the procedures for
filling of vacancies on the Health Services
Planning Board; to provide that Board members
shall serve without compensation but shall be
reimbursed for necessary expenses and Board
members and employees shall be protected from
individual liability; to provide for the annual
election of a Board chairperson and vice
chairperson and to authorize the election of
additional officers; to authorize the appointment
of committees, subcommittees, advisory committees
and task forces to assist the Board in the
exercise of its responsibility; to provide for the
appointment of a Board steering committee to act
for Health Services Planning Board in the time
interval between regular and special meetings; to
specify the procedure for the holding of meetings
and the conduct of business by the Board; to
specify responsibilities and authority of the
Board; to provide a procedure for the handling of
