employ, inter alia, "attorneys", and §7—209 of
this article, which requires the Mass Transit
Administration to "employ a general counsel".
The Maryland Transportation Authority and Mass
Transit Administration appear to be the only
units in the Department thus excepted from the
operation of this section. (See, also, Art.
32A, §5 of the Code; it may be that that
section should be amended to recognize the
existence of exceptions to its requirements.)
2-107. OMITS IN DEPARTMENT.
(A) OMITS ENUMERATED.
THE FOLLOWING UNITS ARE IN THE DEPARTMENT:
(1) STATE AVIATION ADMINISTRATION;
(2) MARYLAND PORT ADMINISTRATION;
(3) MASS TRANSIT ADMINISTRATION;
(4) STATE HIGHWAY ADMINISTRATION;
(5) MOTOR VEHICLE ADMINISTRATION;
(6) BOARD OF AIRPORT ZONING APPEALS;
(7) STATE ROADS COMMISSION;
(8) TRANSPORTATION PROFESSIONAL SELECTION
BOARD; AND
(9) MARYLAND TRANSPORTATION COMMISSION.
(B) OTHER UNITS.
THE DEPARTMENT ALSO INCLUDES ANY OTHER UNIT THAT, IN
ACCORDANCE WITH LAW, IS DECLARED TO BE IN THE DEPARTMENT.
REVISOR'S NOTE: This section presently appears as
Art. 41, §207A.
In subsection (a) of this section, present
references to the "Unsatisfied claim and
Judgment Fund Board", "Maryland Airport Zoning
Board", and "Airport Zoning Commission" are
deleted as obsolete since these units were
abolished by Ch. 73, Acts of 1972, and Ch.
363, Acts of 1974. Also, the references to
the Code sections that established the various
units are eliminated as unnecessary.
Subsection (a)(8) is new language that
reflects the creation of this Selection Board
by Ch. 732, Acts of 1974; see Subtitle 3 of
