(2) IN ACCORDANCE WITH THE FEDERAL ACTS,
ALLOCATE AND APPORTION THESE FEDERAL FUNDS TO ITSELF AND
TO THE POLITICAL SUBDIVISIONS OF THIS STATE;
(3) REPRESENT ANY POLITICAL SUBDIVISION OF
THIS STATE FOR THE PURPOSE OF NEGOTIATING, CONTRACTING,
OR DEALING WITH THE FEDERAL GOVERNMENT AS TO CONSTRUCTION
AND RECONSTRUCTION UNDER THE FEDERAL ACTS;
(4) UNDERTAKE ALL CONTRACTS, PLANS,
SPECIFICATIONS, AND ESTIMATES RELATING TO THIS
CONSTRUCTION AND RECONSTRUCTION; AND
(5) SUPERVISE DIRECTLY THE CONSTRUCTION AND
RECONSTRUCTION WORK DONE UNDER THE FEDERAL ACTS.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of Art. 89B, §76(1) and from Art.
89B, §76(2) and (4).
In this section and throughout this subtitle,
the present listings of various governmental
units (e.g., "any county, the City of
Baltimore, ... {or} any ... special taxing
area") are deleted in favor of the more simple
and equally broad term "political
subdivision".
Similarly, present, misleading references to
"other State or local agencies and
subdivisions of government ... and their duly
elected or appointed officers" are deleted.
As to "other State or local agencies and
subdivisions", the qualification "other" —
when read in context with its antecedent ("any
county ..., city, Municipality, town ...") —
suggests that nothing more than a political
subdivision was intended. (If read more
broadly, these references would appear to
imply that all State and local agencies,
whatever their normal duties and functions,
have been granted vastly broader powers than
envisioned by — and notwithstanding any
express limitations in — their respective
enabling legislation. This implication
apparently was not intended; certainly,
§8-504(a) of this subtitle never was intended
to permit a local liquor board, for example,
to raise funds by taxation.) As to "duly
elected or appointed officers", the reference
is superfluous since these officers would
derive their authority (as would an "agency")
from that granted to this State and its
political subdivisions and subsequently
delegated to them by the State or the
political subdivision.
