BOARD'S JURISDICTION. REVISOR'S NOTE: Subsection (a) of this section is
new language added to clarify the procedures
for certification of cases to the Board of
Property Review; see, also, Maryland Rule U
27. Subsection (b) of this section is new
language derived without substantive change
from Art. 89B, §17(e). In subsection (b) of this section, the present
reference to "the return of an inquisition by
a jury" is deleted as unnecessary in light of
Art. III, §40B of the Constitution, which
requires a jury generally, and Art. IV of the
Constitution and Maryland Rule 15.b, which
permit trial by the court alone if the parties
waive a jury. Present Art. 89B, §20, which provides for
certification of cases pending on June 1,
1956—-the effective date of Ch. 59, Acts of
1956—-is deleted as obsolete. 8-327. BOARDS OF PROPERTY REVIEW. (A)   BOARDS ESTABLISHED; ADDITIONAL BOARDS. (1)    THERE IS A BOARD OF PROPERTY REVIEW IN
EACH COUNTY. (2)   IF NECESSARY, ADDITIONAL BOARDS MAY BE
APPOINTED IN ANY COUNTY. (B)   MEMBERSHIP. (1)    EACH BOARD OF PROPERTY REVIEW HAS THREE
MEMBERS WHO ARE APPOINTED BY THE JUDGES OF THE JUDICIAL
CIRCUIT IN WHICH THE COUNTY IS LOCATED. (2)   OF THE MEMBERS OF EACH BOARD; (I)   ONE SHALL BE A LAWYER; (II)   ONE SHALL BE A FARMER ENGAGED FULL TIME
IN SOME AGRICULTURAL PURSUIT; AND (III) ONE SHALL BE AN ENGINEER OR A PERSON
WITH AN ENGINEERING BACKGROUND AND KNOWLEDGE. (3)    A MEMBER OF THE GENERAL ASSEMBLY MAY NOT
BE A MEMBER OF A BOARD DURING HIS TERM OF OFFICE. (C)   TERM; VACANCIES. (1) EACH BOARD MEMBER SERVES FOR A TERM OF 2
YEARS AND UNTIL HIS SUCCESSOR IS APPOINTED AND QUALIFIES.
