386 LAWS OF MARYLAND
BE CONDEMNED BY THE COMMISSION UNDER PART IV OF THIS
SUBTITLE OR BY THE ADMINISTRATION UNDER TITLE 12 OF THE
REAL PROPERTY ARTICLE. (B) APPLICABILITY OF GENERAL CONDEMNATION LAW. EXCEPT AS PROVIDED IN THIS PART, CONDEMNATION
PROCEEDINGS UNDER THIS PART SHALL FOLLOW THE PROCEDURES
SET FORTH IN TITLE 12 OF THE REAL PROPERTY ARTICLE AND
THE MARYLAND RULES. REVISOR'S NOTE: Subsection (a) of this section is
new language derived from Art. 89B, §10. The
general, constitutional, term "highway
purpose" is substituted tor the present
somewhat varied and inconsistent list of
purposes in present §10. This substitution is
required to reflect, for example, the last
sentence of the first paragraph of present
Art. 89B, §8(a) — see §8-313 of this subtitle
and its revisor's note — and to conform to
§8-312(b) of this subtitle — see revisor's
note to that section. Subsection (b) of this
section is new language added for clarity. In this section and throughout this part,
present language is revised, first, to clarify
that the provisions of this part relate to
condemnation proceedings only and not to other
methods of acquisition and, second, to clarify
the respective jurisdictions and general
authority of the Administration and the
Commission. This Part III and Part IV of this subtitle are
the legislative implementation of Art. III,
§40B or the Constitution and, as such, do not
apply to other types of acquisitions; as to
the relationship between the Administration
and the Commission, see revisor's note to
§8-207 of this title. 8-319. LOCATION OF TERMINI OF HIGHWAY TO BE CONSTRUCTED OR RECONSTRUCTED. PROPERTY MAY BE ACQUIRED UNDER THIS PART FOR A
STATE HIGHWAY ONLY IF THE HIGHWAY HAS: (1)    EACH OF ITS TERMINI WITHIN AN AREA IN THIS
STATE THAT THE ADMINISTRATION RECOGNIZES AS A PRINCIPAL TRAFFIC GENERATING CENTER; (2)   EACH OF ITS TERMINI AT OR NEAR A PUBLIC HIGHWAY IN THIS STATE; (3)           ONE TERMINUS         WITHIN         AN AREA IN THIS STATE
THAT THE ADMINISTRATION RECOGNIZES AS A PRINCIPAL TRAFFIC
GENERATING CENTER AND THE OTHER TERMINUS AT OR NEAR A
