(I) GRANTS IN AID. (1)    THE SECRETARY MAY APPLY FOR AND RECEIVE
FROM THE FEDERAL GOVERNMENT OR ANY PERSON ANY GRANTS IN
AID OR GIFTS FOR ANY TRANSPORTATION RELATED PURPOSE. (2)    TO THE EXTENT PERMITTED BY THE STATE
BUDGET, THE SECRETARY MAY MAKE GRANTS IN AID TO: (I)   ANY GOVERNMENTAL TRANSPORTATION AGENCY IN
THIS STATE, INCLUDING ANY COUNTY AGENCY, BICOUNTY AGENCY,
MULTIJURISDICTION AGENCY, OR MUNICIPAL AGENCY; OR (II)  ANY OTHER PERSON FOR ANY TRANSPORTATION
RELATED PURPOSE. REVISOR'S NOTE: This subsection presently appears as
Art. 41, § 208(g) and (m). In paragraph (2)(ii) of this subsection, the
present reference to "corporation...or other
entity" is deleted as unnecessary in light of
the definition of "person" in §1—101 of this
article. The only other changes are in style. As to funds received by the Department under
paragraph (1) of this section, see, also, Art.
15A, §§ 5 and 6 of the Code. 2-104. ACQUISITION OF PROPERTY WITH STATE RETIREMENT
SYSTEMS FUNDS. (A)   IN GENERAL. IN ADDITION TO ITS OTHER POWERS AND DUTIES AND
NOTWITHSTANDING ANY PROVISIONS OF ARTICLES 73B, 77, AND
88B OF THE CODE OR OF ANY OTHER STATUTE, THE DEPARTMENT
MAY FINANCE THE ACQUISITION, BY PURCHASE OR CONDEMNATION,
OF ANY REAL PROPERTY THAT IT CONSIDERS NECESSARY FOR
FUTURE IMPROVEMENT OF THE STATE TRANSPORTATION SYSTEM, AS
PROVIDED IN THIS SECTION. (B)   AGREEMENTS WITH RETIREMENT SYSTEMS. (1)   THE SECRETARY MAY MAKE ONE OR MORE
AGREEMENTS, SINGLY OR JOINTLY, WITH THE TRUSTEES OF THE
EMPLOYEES' RETIREMENT SYSTEM OF THE STATE OF MARYLAND,
THE TEACHERS' RETIREMENT SYSTEM OF THE STATE OF MARYLAND,
OR THE STATE POLICE RETIREMENT SYSTEM OF THE STATE OF
MARYLAND FOR THE ACQUISITION OF THE REAL PROPERTY. (2)   THESE AGREEMENTS MAY BE MADE FOR THE
ACQUISITION AND FINANCING OF AN INDIVIDUAL PARCEL OR OF
ANY NUMBER OF PARCELS WITHIN THE LIMITS OF A CONTEMPLATED
TRANSPORTATION PROJECT.
