"may". In paragraph (2) (ii) of this subsection,
present references to "the Maryland Airport
Zoning Board" and "the Airport Zoning
Commission" are deleted as obsolete since
these units were abolished by Ch. 363, Acts of
1974. Also in paragraph (2) (ii) , reference is added
to the Transportation Professional Services
Selection Board, recently created by Ch. 732,
Acts of 1974. The independence of this Board
is critical to the exercise of its functions;
and the Commission suspects that its omission
from this list is but an oversight. See,
also, subsection (f) of this section and its
revisor's note. The only other changes are in style. As to use of the term "unit", see revisor's
note to §2—102 of this subtitle. (H) CONTRACTS. CONSISTENT WITH THE STATE BUDGET AND SUBJECT TO
APPROVAL OF THE BOARD OF PUBLIC WORKS, THE SECRETARY MAY
CONTRACT WITH ANY PERSON TO PROVIDE SERVICES, INCLUDING
CONSULTANT SERVICES, FOR THE DEPARTMENT OR FOR ANY
TRANSPORTATION RELATED PURPOSE. REVISOR'S NOTE: This subsection is new language that
combines without substantive change Art. 41,
§§ 207(f) and 208(k). The present reference in §208(k) to "agencies
... and any ... corporation, association or
other entity" is deleted as unnecessary in
light of the definition of "person" in §1—101
of this article. As to contracts for consultant services, by
Executive Order of the Governor, June 15,
1971, the Department is to submit any
consulting contract to the Department of
Budget and Fiscal Planning, which, in turn,
will include the contract on its agenda for
the Board of Public Works, for approval in
accordance with this provision; see Executive
Orders of the Governor in Supplement to Code
Volume 9A. As to professional services of
architects and engineers, see, also, Subtitle
3 of this title, which establishes the
Transportation Professional Services Selection
Board and governs the procurement of
architectural and engineering services.
