8-217. CONFLICTS OF INTEREST PROHIBITED. A MEMBER OF THE COMMISSION MAY NOT HAVE ANY
FINANCIAL INTEREST IN ANY CONTRACT MADE FOR WORK,
MATERIAL, OR OTHERWISE IN CONNECTION WITH ANY OF THE
ACTIVITIES OF THE ADMINISTRATION. REVISOR'S NOTE: This section is new language derived
from the eighth sentence of Art. 89B, §3(a). The section is expanded to prohibit interests
in transactions of the "Administration",
generally, and not just the Commission, since
the Administration now performs the
construction and Maintenance functions
formerly performed by the Commission. It also
is expanded to apply also to contracts for
things other than work or materials, e.g.,
loans. The only other changes are in style. As to different approaches taken to guard
against conflicts in other units of the
Department, see §§ 2-304 and 6-212 of this
article and compare with this section. 8-218. POWERS AND DUTIES OF COMMISSION. (A)   IN GENERAL. THE COMMISSION HAS THE POWERS AND DUTIES: (1)   THAT ARE VESTED IN IT BY ARTICLE III,
§40B OF THE STATE CONSTITUTION, SUBJECT TO AND IN
ACCORDANCE WITH THE PROVISIONS OF SUBTITLE 3, PARTS III
AND IV OF THIS TITLE; AND (2)   THAT OTHERWISE ARE VESTED IN IT BY LAW OR
DELEGATED TO IT BY THE ADMINISTRATE OR THE SECRETARY. (B)      "QUICK-TAKE" CONDEMNATION EXCLUSIVE IN
COMMISSION. ONLY THE COMMISSION MAY EXERCISE THE CONDEMNATION
POWERS AND DUTIES VESTED IN IT BY ARTICLE III, §40B OF
THE STATE CONSTITUTION. REVISOR'S NOTE: This section is new language derived
from numerous references in present Art. 89B
(see, e.g., present Art. 89B, §§3(b) and 7(b))
to the Constitutional "quick—take" authority,
which is exclusively in the Commission. Subsection (a) (2) is added to recognize
expressly the other powers and duties that
from time to time might be vested in it by law
