The only other changes are in style. The balance of the ninth sentence of present
Art. 89B, §3(a), which authorizes the
Chairman/Administrator to establish
departments within the Commission, is deleted
as unnecessary in light of the general
authority implicit in his status as chief
executive of the Administration. See, also,
§2-103(f) of this article as to the general
reorganization authority of the Secretary. 8-214. COMMISSION SECRETARY. (A) APPOINTMENT. WITH THE APPROVAL OF THE SECRETARY OF
TRANSPORTATION, THE COMMISSION SHALL APPOINT A SECRETARY
TO THE COMMISSION. (B) QUALIFICATIONS. THE COMMISSION SECRETARY MAY NOT BE A MEMBER OF THE
COMMISSION. (C)   COMPENSATION. THE COMMISSION SECRETARY IS ENTITLED TO THE
COMPENSATION THAT THE SECRETARY DETERMINES, AS PROVIDED
IN THE STATE BUDGET. (D)   DUTIES. THE COMMISSION SECRETARY SHALL: (1)      KEEP ACCURATE MINUTES OF ALL MEETINGS AND
RECORDS OF ALL OTHER TRANSACTIONS OF THE COMMISSION; (2)         MAKE COPIES OF ALL NOTICES THAT THE
CHAIRMAN DIRECTS TO BE PUBLISHED;
(3) PRESERVE ALL CERTIFICATES OF PUBLICATION;
AND
(4) PERFORM ANY OTHER DUTIES IMPOSED BY LAW
OR ASSIGNED BY THE CHAIRMAN. REVISOR'S NOTE: This section is new language derived
without substantive change from the second
paragraph of Act. 89B, §1. The present provisions of that paragraph that
require the Commission Secretary to enter all
minutes and records in the Commission's
journal are deleted as unnecessary in light of
§8-216 of this subtitle.
