MARVIN MANDEL, Governor                            3627 ORDINANCE WILL BE SCHEDULED FOR CONSIDERATION AND APPROVAL BY THE TAXING AUTHORITY SHALL BE ANNOUNCED AT THE PUBLIC HEARING. (E) THE DEPARTMENT SHALL NOTIFY EACH TAXING AUTHORITY OF ANY CHANGE IN THE ASSESSABLE BASE WHICH
RESULTS FROM ACTIONS BY TAX APPEAL BOARDS OR THE STATE
TAX COURT. AN INCREASE IN THE TAXING AUTHORITY'S TAX RATE ABOVE THE CONSTANT YIELD TAX RATE AS DETERMINED BY THE DEPARTMENT OR ADOPTED BY RESOLUTION OR ORDINANCE OF THE GOVERNING BODY OF THE TAXING AUTHORITY WHICH IS REQUIRED SOLELY BY A REDUCTION OF THE ASSESSMENT RECORDS
BY A COUNTY BOARD OF TAX APPEALS, OR STATE TAX COURT, MAY
BE ADOPTED WITHOUT FURTHER NOTICE AND NOTWITHSTANDING THE
REQUIREMENTS OF SECTION E ABOVE. (F) THIS SECTION DOES NOT PREVENT THE REDUCTION OF
THE TAX RATE. (G) THE DIRECTOR OF THE DEPARTMENT MAY EXEMPT A MUNICIPAL CORPORATION FROM THE PROVISIONS OF THIS SECTION IF THE DIRECTOR BELIEVES THE AMOUNT OF INCREASE IN THE ASSESSABLE BASE DOES NOT JUSTIFY THE PROCEDURAL
REQUIREMENTS OF THIS SECTION.
SECTION 2. AND BE IT FURTHER ENACTED, That if any
provision of this Act or the application thereof to any
person or circumstance is held invalid for any reason in
a court of competent jurisdiction, the invalidity does
not affect other provisions or any other application of
this Act which can be given effect without the invalid provision or application, and for this purpose the provisions of this Act are declared severable.
SECTION 2 3. AND BE IT FURTHER ENACTED, That this
Act shall take effect July 1, 1977. Approved May 26, 1977.
CHAPTER 965 (House Bill 1575) AN ACT concerning Pensions — Workmen's Compensation Commissioners FOR the purpose of changing the membership of the
Employees' Retirement System as it applies to the
Commissioners of the Workmen's Compensation Commission; providing that any Commissioner of the
Workmen's Compensation Commission is included in the
Judges' Retirement System (contributing plan),
