(C) (1) IN ENFORCING THE PROVISIONS OF LAW
SPECIFIED IN SUBSECTION (B), THE ENFORCEMENT UNIT MAY:
(I) CONDUCT INVESTIGATIONS AND HOLD
HEARINGS;
(II) SUBPOENA WITNESSES, EXAMINE
PERSONS UNDER OATH, AND RECEIVE EVIDENCE; AND
(III) COMPEL THE PRODUCTION OF RECORDS,
ACCOUNTS, BOOKS, PAPERS, AND OTHER DOCUMENTS.
(2) IF ANY PERSON FAILS TO APPEAR OR
TESTIFY, OR FAILS TO ANSWER ANY ORAL OR WRITTEN QUESTION
OR PRODUCE ANY DOCUMENT, THE COMPTROLLER MAY APPLY TO THE
CIRCUIT COURT OF THE COUNTY IN WHICH THE PERSON HAS
SERVED, OR THE SUPREME BENCH OF BALTIMORE CITY, FOR AN
ORDER REQUIRING COMPLIANCE. THE COMPTROLLER'S
APPLICATION SHALL BE ACCOMPANIED BY A COPY OF THE
SUBPOENA AND PROOF OF SERVICE. FAILURE TO OBEY AN ORDER
OF THE COURT SUBJECTS THE PERSON TO THE SAME PENALTIES AS
IN THE CASE OF A WITNESS SUBPOENAED BY THE COURT IN THE
TRIAL OF A CIVIL ACTION,
(D) THE ENFORCEMENT UNIT SHALL COOPERATE WITH AND
ASSIST THE FEDERAL GOVERNMENT, OTHER STATES, AND LOCAL
GOVERNMENT UNITS, AND THE LAW ENFORCEMENT PERSONNEL
THEREOF, IN ENFORCING THE PROVISIONS SPECIFIED IN
SUBSECTION (B).
(E) THE COMPTROLLER'S OFFICE SHALL PAY THE
SALARIES AND EXPENSES OF ALL MARYLAND STATE POLICE
PERSONNEL ASSIGNED TO THE ENFORCEMENT UNIT. THE MARYLAND
STATE POLICE SHALL ASSIST THE ENFORCEMENT UNIT IN
CARRYING OUT THE PROVISIONS OF THIS SECTION.
(F) THE POWERS GRANTED BY THIS SECTION ARE IN
ADDITION TO ANY OTHER POWERS GRANTED TO THE COMPTROLLER
OR HIS AGENT PURSUANT TO THE PROVISIONS SPECIFIED IN
SUBSECTION (B).
SECTION 3. AND BE IT FURTHER ENACTED, That Section
233 of Article 27 — Crimes and Punishments, of the
Annotated Code of Maryland (1976 Replacement Volume and
1976 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows:
Article 27 — Crimes and Punishments
233.
(A) Any person, copartnership or corporation, or
any member, officer, agent or employee of any
copartnership or corporation, who shall violate any
provision of this subtitle, shall have the right to
demand and receive a [summons in the same manner]
CITATION as [is] provided in [Article 66 1/2, § 16-109
of the Annotated Code of Maryland] TITLE 26 OF THE
