"road", see subsection (n) of this section. The term "property" is defined in §1-101 of
this article. The only other changes are in style. (I) INTERSTATE HIGHWAY. "INTERSTATE HIGHWAY" MEANS A STATE HIGHWAY THAT IS
PART OF THE NATIONAL INTERSTATE SYSTEM IN THIS STATE, AS
DESIGNATED BY THE ADMINISTRATION AND APPROVED BY THE
UNITED STATES SECRETARY OF TRANSPORTATION UNDER TITLE 23
OF THE UNITED STATES CODE. REVISOR'S NOTE: This section is new language that
combines without substantive change Art. 89B,
§§240(e) and 251(m). Reference to the fact that interstate highways
are "State" highways is added for clarity. As to the referenced federal statute relating
to interstate highways, see 23 U.S.C. §103. (J) MAINTENANCE. (1)      "MAINTENANCE" MEANS THE UPKEEP AND
REPAIR BY WHICH A HIGHWAY, BUILDING, EQUIPMENT, AND OTHER
PROPERTY IS KEPT IN AN ORDINARILY EFFICIENT OPERATING
CONDITION. (2)      "MAINTENANCE" DOES NOT INCLUDE
CONSTRUCTION, RECONSTRUCTION, OR RELOCATION. REVISOR'S NOTE: This subsection presently appears as
Art. 89B, §2(g). In paragraph (2) of this subsection, the
reference to "construction" is added for
clarity. The only other changes are in style. (K) PRIMARY HIGHWAY. "PRIMARY HIGHWAY" MEANS A STATE HIGHWAY THAT HAS
BEEN DESIGNATED A PRIMARY HIGHWAY BY THE ADMINISTRATION
WITH THE APPROVAL OF THE SECRETARY.
