CHAPTER 920
(Senate Bill 927)
AN ACT concerning
Local Boards of Education - Litigation
FOR the purpose of requiring permitting county boards of
education and the Board of School Commissioners of
Baltimore City to pay all or part of the counsel
fees for the defense of members of those boards who
become involved in litigation caused by service on
those boards.

(1975 Replacement Volume and 1976 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 56E be and it is hereby added
to Article 77 — Public Education, of the Annotated Code
of Maryland (1975 Replacement Volume and 1976 Supplement)
to read as follows:
Article 77 — Public Education
56E.
THE COUNTY BOARDS OF EDUCATION AND THE BOARD OF
SCHOOL COMMISSIONERS OF BALTIMORE CITY SHALL PAY COUNSEL
FEES MAY, IN THE DISCRETION OF THE BOARD, PROVIDE LEGAL
REPRESENTATION MAY PAY ALL OR PART OF THE COUNSEL FEES
FOR THE DEFENSE OF ANY MEMBER OF THE RESPECTIVE BOARD WHO
BECOMES INVOLVED IN LITIGATION CAUSED BY HIS SERVICE AND
IN HIS OFFICIAL CAPACITY ON THAT BOARD AND SUCH PAYMENTS
SHALL BE CONSIDERED A VALID EDUCATIONAL EXPENSE.
