AN ACT concerning
Insurance — Maternity Disability Benefits
FOR the purpose of requiring certain health insurance
policies to include insurers to offer in certain
insurance policies the option of providing benefits
for temporary disability related to pregnancy, and
or childbirth with certain limitations; and
generally relating to certain disability insurance
benefits.

Sections 354K, 470K and Section 477N

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 354K, 470K and Section 477N
be and they are hereby added to Article 48A - Insurance
Code, of the Annotated Code of Maryland (1972 Replacement
Volume and 1976 Supplement) to read as follows:

EVERY NONPROFIT HEALTH SERVICE PLAN WHICH PROVIDES
ANY BENEFITS FOR TEMPORARY DISABILITY SHALL INCLUDE
BENEFITS FOR TEMPORARY DISABILITY CAUSED OR CONTRIBUTED
TO BY PREGNANCY OR CHILDBIRTH. THESE BENEFITS SHALL BE
PROVIDED TO THE SAME EXTENT AND ON THE SAME TERMS AS
BENEFITS APPLIED TO ANY OTHER COVERED DISABILITY EXCEPT
THAT BENEFITS FOR DISABILITIES CAUSED BY A NORMAL
PREGNANCY OR NORMAL CHILDBIRTH MAY BE LIMITED TO SIX
WEEKS OR MORE. THIS SECTION APPLIES TO ALL POLICIES
WHICH ARE ISSUED OR DELIVERED WITHIN THIS STATE OR WHICH
ARE ISSUED OR DELIVERED TO ANY ENTITY WHICH IS
INCORPORATED OR HAS A MAIN OFFICE LOCATED IN THIS STATE
OR WHICH COVERS ANY PERSON WHO RESIDES OR WORKS WITHIN
THIS STATE.
