BY adding to
Article 43 - Health
Section 42H
Annotated Code of Maryland
(1971 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 42A(b) of Article 43 - Health, of
the Annotated Code of Maryland (1971 Replacement Volume
and 1976 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows:
Article 43 - Health
42A.
(b) These funds shall be used by the State
Department of Health AND MENTAL HYGIENE solely for the
purpose of supplementing the State general funds
appropriated for hospital care so that payments for
hospital service rendered to indigent and medically
indigent patients will be made at [full current cost as
determined by the step-down accounting method in
conjunction with the ratio of charge to cost procedures
as recommended by the Maryland Legislative Council's
committee on taxation and fiscal matters] REIMBURSEMENT
RATES AS PAID BY THE MARYLAND MEDICAL ASSISTANCE PROGRAM.

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 42H be and it is hereby added to Article 43 -
Health, of the Annotated Code of Maryland (1971
Replacement Volume and 1976 Supplement) to read as
follows:
Article 43 - Health
42H.
THE DEPARTMENT OF HEALTH AND CENTAL HYGIENE SHALL
REIMBURSE ACUTE GENERAL AND CHRONIC CARE HOSPITALS THAT
PARTICIPATE IN THE MARYLAND MEDICAL ASSISTANCE PROGRAM
FOR CARE PROVIDED TO MEDICAL ASSISTANCE RECIPIENTS IN
ACCORDANCE WITH RATES THAT THE HEALTH SERVICES COST
REVIEW COMMISSION APPROVES UNDER §§ 568H THROUGH 568Y OF
THIS ARTICLE, IF SOCIAL AND REHABILITATION SERVICES OF
THE DEPARTMENT OF HEALTH, EDUCATION, AND WELFARE APPROVES
THIS REIMBURSEMENT METHODOLOGY.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
