Preamble
It is the intent of the Legislature that for a
law-enforcement officer to qualify for administrative
leave under the provisions of this section, he must have
incurred an injury in the line of duty and while in the
active enforcement of the laws or prevention of a crime.
It is not intended to apply to a law-enforcement officer
engaged in administrative duties and injured while
performing those duties.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 23A be and it is hereby added
to Article 88B - State Police, of the Annotated Code of
Maryland (1969 Replacement Volume and 1976 Supplement) to
read as follows:
Article 88B — State Police
23A.
THE SUPERINTENDENT, OR CHIEF, OF A STATE
LAW ENFORCEMENT AGENCY OR DEPARTMENT OF STATE POLICE MAY
GRANT ADMINISTRATIVE LEAVE TO A LAW ENFORCEMENT OFFICER
LAW-ENFORCEMENT OFFICERS IN HIS AGENCY DEPARTMENT
INJURED OR WOUNDED IN THE LINE OF DUTY WHILE IN THE
ACTIVE PREVENTION OF CRIME. THE ADMINISTRATIVE LEAVE
REMAINS IN EFFECT UNTIL THE LAW ENFORCEMENT STATE POLICE
OFFICER IS RETURNED TO DUTY OR IS RETIRED BY REASON OF
THOSE INJURIES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
