The only changes are in style.
See, also, Art. 41, §3A(a), which provides
that a secretary of a principal department "is
responsible for the comprehensive planning of
programs and services within his jurisdiction
and for reviewing and approving the plans for
all departments and other units of the State
government within his jurisdiction".
(F) TRANSFER OF STAFF, POWERS, AND DUTIES.
(1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF
THIS SUBSECTION, THE SECRETARY MAY TRANSFER, ASSIGN, AND
REASSIGN ANY STAFF, POWER, OR DUTY FROM ANY UNIT IN THE
DEPARTMENT TO HIS OFFICE OR TO ANOTHER UNIT IN THE
DEPARTMENT. IF A TRANSFER, ASSIGNMENT, OR REASSIGNMENT
OCCURS, THE APPROPRIATION FOR THE RESPECTIVE STAFF,
POWER, OR DUTY ALSO SHALL BE TRANSFERRED.
(2) THIS SUBSECTION DOES NOT APPLY TO:
(I) THE POWERS OR DUTIES OF THE STATE ROADS
COMMISSION THAT ARE SET FORTH IN ARTICLE III, §40B OF THE
STATE CONSTITUTION; OR
(II) THE POWERS OR DUTIES THAT ARE VESTED BY
LAW IN:
1. THE BOARD OF AIRPORT ZONING APPEALS;
2. THE TRANSPORTATION PROFESSIONAL SERVICES
SELECTION BOARD;
3. THE MARYLAND TRANSPORTATION AUTHORITY; OR
4. THE BOARD OF REVIEW OF THE DEPARTMENT.
REVISOR'S NOTE: This subsection presently appears as
Art. 41, §208(d).
Throughout this section, present references to
"responsibilities" and "functions" are deleted
as redundant in light of the references to
"powers" and "duties".
In paragraph (2)(i) of this subsection, the
word "duties" is added to conform to similar
language in present Art. 41, §208(h), now
subsection (g) of this section, and in
paragraph (2) (ii) of this subsection.
In paragraph (2)(ii) of this subsection,
present references to the "Unsatisfied Claim
and Judgment Fund Board", "Maryland Airport
Zoning Board", and "Airport Zoning Commission"
are deleted as obsolete since these units were
