CHAPTER 854
(House Bill 1984}
AN ACT concerning
Rape and Sexual Offenses - Doctor and Hospital Charges
FOR the purpose of providing that victims of rape and
sexual offenses may not be charged for the costs of
certain examinations, tests, or treatment by
physicians or hospitals; providing for the
reimbursement by the Department of Health and Mental
Hygiene to doctors and hospitals for the cost of
these services; providing for the procedure for
reimbursement to the Department and prospective
subrogation of any insurance rights of the victims;
and authorizing the Department to establish
standards and rules and regulations.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 31D be and it is hereby added
to Article 43 - Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1976 Supplement) to read as
follows:

(A) WHENEVER A DOCTOR OR A HOSPITAL PROVIDES ANY
PHYSICAL EXAMINATION, TEST, OR TREATMENT OF ANY VICTIM OF
