AN ACT concerning Patuxent River Watershed Area - Use of Federal funds FOR the purpose of requiring the Department of Health and
Mental Hygiene to appropriate certain federal funds
for use in upgrading and floodproofing of existing
sewerage systems, collector lines, and facilities in
the Patuxent River watershed area before the funds
may be appropriated for use in constructing new
systems or facilities; and specifying certain
exceptions. BY adding to Article 43 - Health Section 394 1/2 Annotated Code of Maryland (1971 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 394 1/2 re and it is hereby
added to Article 43 - Health of the Annotated Code of
Maryland (1971 Replacement Volume and 1976 Supplement) to
read as follows: Article 43 - Health 394 1/2. (A) ALL FEDERAL GRANTS, LOANS, OR OTHER FUNDS
AVAILABLE TO THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE
WHICH ARE TO BE SPENT ON SEWERAGE SYSTEMS IN THE PATUXENT
RIVER WATERSHED AREA SHALL BE APPROPRIATED BY THE
DEPARTMENT AS FOLLOWS: (1) AVAILABLE FUNDS SHALL BE APPROPRIATED
FOR USE IN UPGRADING AND FLOODPROOFING EXISTING SEWERAGE
SYSTEMS, COLLECTOR LINES, OR FACILITIES IN THE AREA TO
MEET STANDARDS CURRENTLY IN EFFECT PURSUANT TO THIS
SUBTITLE. AVAILABLE FUNDS MAY NOT BE APPROPRIATED FOR
USE IN CONSTRUCTING ANY NEW SYSTEMS, COLLECTOR LINES, OR
FACILITIES IN THE AREA IF THE FUNDS COULD BE UTILIZED TO
UPGRADE AND FLOODPROOF ANY EXISTING SYSTEMS, COLLECTOR
LINES, OR FACILITIES IN THE AREA. (2) NOTWITHSTANDING PARAGRAPH (1) OF THIS SUBSECTION, AVAILABLE FUNDS MAY BE APPROPRIATED FOR USE IN EXPENDING EXISTING SYSTEMS, COLLECTOR LINES, OR FACILITIES, IF THE SYSTEM, COLLECTOR LINES, OR FACILITY TO BE EXPANDED IS ALSO UPGRADED AND FLOODPROOFED TO MEET STANDARDS CURRENTLY IN EFFECT PURSUANT TO THIS SUBTITLE. (3)(2)               NOTWITHSTANDING PARAGRAPH 1 OF THIS SUBSECTION, AVAILABLE FUNDS MAY BE APPROPRIATED FOR
