MARVIN MANDEL, Governor                           3253 ELECTION. (2) AT THEIR FIRST MEETING OF EACH YEAR, THE
MEMBERS SHALL ELECT ONE OF THE MEMBERS TO BE CHAIRMAN OF
THE BOARD FOR THAT YEAR. (G)(H) (1) A MEMBER OF THE BOARD IS ENTITLED
TO AN ANNUAL SALARY OF $1,800. THE CHAIRMAN OF THE BOARD
IS ENTITLED TO AN ANNUAL SALARY OF $2,000. THE COUNTY
COMMISSIONERS OF SOMERSET COUNTY MAY PROVIDE FOR GREATER
COMPENSATION IN THE COUNTY BUDGET. (2) A MEMBER OR CHAIRMAN OF THE BOARD IS
ENTITLED TO REIMBURSEMENT FOR EXPENSES INCURRED BY
OFFICIAL DUTIES OUTSIDE SOMERSET COUNTY. (H)(I) (1) THE BOARD SHALL PERFORM THE
FUNCTION OF A COUNTY BOARD OF EDUCATION AS PROVIDED BY
STATE LAW. THE BOARD MAY ADOPT THOSE RULES AND
REGULATIONS NECESSARY FOR THE PROPER ADMINISTRATION OF
THE SCHOOLS IN SOMERSET COUNTY. (2) THE BOARD SHALL MAKE ALL FINAL
DETERMINATIONS AT A PUBLIC MEETING AND SHALL MAINTAIN A
FORMAL RECORD OF SUCH A MEETING. THE BOARD MAY MEET AND
DELIBERATE IN EXECUTIVE SESSION ONLY IF ANY FINAL ACTION
IS TAKEN AT A PUBLIC MEETING. (I)(J) (1) THE STATE BOARD OF EDUCATION MAY
REMOVE A MEMBER OF THE BOARD OF EDUCATION OF SOMERSET
COUNTY FOR IMMORALITY, MISCONDUCT IN OFFICE,
INCOMPETENCY, OR WILFUL NEGLECT OF DUTY. THE STATE BOARD
SHALL PRESENT A COPY OF ALL CHARGES MADE TO THE MEMBER
AND SHALL GIVE HIM AN OPPORTUNITY TO BE PUBLICLY HEARD IN
PERSON OR BY COUNSEL IN HIS DEFENSE. THE STATE BOARD
SHALL GIVE AT LEAST TEN DAYS' NOTICE OF A HEARING TO THE
PERSON CHARGED. (2) A PERSON REMOVED BY THE STATE BOARD OF
EDUCATION MAY APPEAL TO THE CIRCUIT COURT FOR A REVIEW OF
THE REMOVAL. THE CIRCUIT COURT SHALL HEAR THE APPEAL DE
NOVO. (J)(K) THE GOVERNOR SHALL APPOINT A QUALIFIED
PERSON TO FILL A VACANCY ON THE BOARD OF EDUCATION OF
SOMERSET COUNTY. A PERSON APPOINTED BY THE GOVERNOR
SHALL SERVE THE UNEXPIRED PORTION OF THE VACATED TERM.
SECTION 2. AND BE IT FURTHER ENACTED, That those
members of the Board of Education holding office on July
1, 1977 shall continue in office until January 1, 1981.
SECTION 3. AND BE IT FURTHER ENACTED, That before
this Act becomes effective it shall first be submitted to
a referendum of the legally qualified voters of Somerset
County at the general election to be held in November of
