MARVIN MANDEL, Governor
filing and election procedures, and salaries and
expenses for the members; delineating certain
functions and responsibilities of the board;
providing for removal of member and vacancies on the
board; generally relating to an elected school board
for Somerset County; and submitting this Act to the
qualified voters of Somerset County for their
adoption or rejection. BY adding to Article 77 — Public Education Section 35C Annotated Code of Maryland (1975 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 35C be and it is hereby added
to Article 77 - Public Education, of the Annotated Code
of Maryland (1975 Replacement Volume and 1976 Supplement)
to read as follows; Article 77 - Public Education 35C. (A)    (1) THE BOARD OF EDUCATION OF SOMERSET
COUNTY IS COMPOSED OF FIVE MEMBERS ELECTED BY THE QUALIFIED VOTERS OF SOMERSET COUNTY. THE COUNTY COMMISSIONERS OF SOMERSET COUNTY ARE EX OFFICIO MEMBERS OF THE BOARD OF EDUCATION. (2)    FOUR MEMBERS OF THE BOARD SHALL EACH
RESIDE IN A DIFFERENT COUNCILMANIC DISTRICT. THE FIFTH
MEMBER SHALL RESIDE IN SOMERSET COUNTY. ALL MEMBERS
SHALL BE REGISTERED VOTERS OF SOMERSET COUNTY. ALL
MEMBERS SHALL BE ELECTED BY ALL THE REGISTERED VOTERS OF
SOMERSET COUNTY. (3)    A MEMBER WHO CEASES TO BE A RESIDENT OF
SOMERSET COUNTY, OR, IN THE CASE OF THE FOUR MEMBERS
REQUIRED TO RESIDE IN SPECIFIC COUNCILMANIC DISTRICTS, A
MEMBER WHO CEASES TO BE A RESIDENT OF THE REQUIRED
COUNCILMANIC DISTRICT MAY NOT CONTINUE TO SERVE ON THE
BOARD OF EDUCATION. (B)    (1) A PERSON IS ELIGIBLE FOR CANDIDACY FOR ELECTION TO THE BOARD OF EDUCATION WHO: (I)    OBTAINS THE SIGNATURES OF AT LEAST
200 REGISTERED VOTERS ON A PETITION WHICH CONFORMS TO THE
REQUIREMENTS FOR PETITIONS IN ARTICLE 33, EXCEPT THAT
PUBLICATION OF THE PETITION IS NOT REQUIRED; (II)   FILES THAT PETITION WITH THE BOARD
OF SUPERVISORS OF ELECTIONS BY 4:00 P.M. ON THE MONDAY
WHICH IS 70 DAYS BEFORE THE DAY ON WHICH THE GENERAL
