AMOUNT OF INCREMENTAL INDIRECT COSTS ALLOCATED BY THE
DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONAL SERVICES TO
THE STATE POLICE FOR LAW-ENFORCEMENT DUTIES PERFORMED ON
ADMINISTRATION PROPERTY. THESE FUNDS SHALL BE
TRANSFERRED IN THE ANNUAL BUDGET BILL TO THE STATE POLICE
AND USED AS SPECIAL RECEIPTS FOR THE EXPENDITURES OF THE
STATE POLICE IN PERFORMING THESE DUTIES.
(3) THE SECRETARY OF TRANSPORTATION MAY
TRANSFER TO THE DEPARTMENT OF PUBLIC SAFETY AND
CORRECTIONAL SERVICES SUCH POSITIONS AS ARE NECESSARY TO
IMPLEMENT THIS SUBSECTION.
(4) AN OFF-DUTY POLICE EMPLOYEE OR AIRPORT
POLICE EMPLOYEE WHO VOLUNTARILY PERFORMS LAW-ENFORCEMENT
DUTIES ON STATE AVIATION ADMINISTRATION PROPERTY MAY NOT
RECEIVE OVERTIME COMPENSATION FOR THE PERFORMANCE OF
THOSE DUTIES. IN ALL OTHER RESPECTS, OVERTIME PROVISIONS
FOR POLICE EMPLOYEES AND AIRPORT POLICE EMPLOYEES SHALL
BE AS PROVIDED IN SECTION 76(D) OF ARTICLE 100.

SECTION 2. AND BE IT FURTHER ENACTED, That Section
5—101(k) of Article — Transportation, of the Annotated
Code of Maryland (As enacted by Chapter of the Acts
of the General Assembly of 1977) be and it is hereby
repealed and reenacted, with amendments, to read as
follows;
Article - Transportation
5-101.
(k) "Police officer" means [ :
(1) Any State Aviation Administration police
officer; and
(2) ] Any [other] State or local officer
authorized to make arrests for violations of State or
local laws.

SECTION 2 3. AND BE IT FURTHER ENACTED, That
Section 5-212 of Article — Transportation, of the
Annotated Code of Maryland (As enacted by Chapter __ of
the Acts of the General Assembly of 1977) be and it is
hereby repealed.
SECTION 3 4. AND BE IT FURTHER ENACTED, That new
Section 5—212 be and it is hereby added to Article -
Transportation, of the Annotated Code of Maryland (As
enacted by Chapter ____ of the Acts of the General
Assembly of 1977) to read as follows:
