(a) For a violation of the contract with a student, or for other good cause, the [State Superintendent is authorized to] BOARD MAY revoke the
permit issued to any solicitor, after due notice of [said] THE revocation to the solicitor[,] and an opportunity [afforded to the solicitor,] to be heard on
[said] THE revocation. (b) Any solicitor aggrieved by any decision of the
[State Superintendent hereunder, shall have] BOARD HAS
the right to appeal [said] THE decision to the circuit court of the county or to the Baltimore City Court, as the case may be, [wherein said] WHERE THE solicitor
operates or proposes to operate. (II) "SCHOOL" MEANS AN APPROVED PRIVATE
POSTSECONDARY EDUCATIONAL INSTITUTION LOCATED OUTSIDE OF
THE STATE OF MARYLAND WHICH CHARGES TUITION OR FEES FOR
ATTENDANCE OR INSTRUCTION TO STUDENTS WITHIN THE STATE OF
MARYLAND, WHICH OFFERS A PROGRAM OF TRADE OR TECHNICAL EDUCATION OR BOTH, OR WHICH GIVES PREEMPLOYMENT OR SUPPLEMENTARY TRAINING OR BOTH, IN THE FIELDS OF TRADE OR INDUSTRY; BUT THIS TERM SHALL NOT INCLUDE ANY POSTSECONDARY INSTITUTION SUBJECT TO THE AUTHORITY OF THE
STATE BOARD FOR HIGHER EDUCATION UNDER SECTION 32A OF
THIS ARTICLE. (2) EVERY SOLICITOR FOR ANY PRIVATE POSTSECONDARY SCHOOL DEFINED IN SUBPARAGRAPH (II) ABOVE
SHALL APPLY TO THE STATE BOARD FOR HIGHER EDUCATION FOR
AN ANNUAL PERMIT ON JULY 1 OF EACH YEAR. THE APPLICATION
SHALL BE MADE ON FORMS SUPPLIED BY THE BOARD AND SHALL
CONTAIN SUCH INFORMATION AS THE BOARD DEEMS REASONABLE AND NECESSARY. TOGETHER WITH THE APPLICATION THE SOLICITOR SHALL SUBMIT FOR APPROVAL A COPY OF EACH TYPE
OF CONTRACT OFFERED BY THE SOLICITOR TO PROSPECTIVE STUDENTS, TOGETHER WITH SUCH ADVERTISING MATERIALS AND OTHER REPRESENTATIONS AS ARE MADE BY THE SCHOOL TO ITS STUDENTS OR PROSPECTIVE STUDENTS. (3) AFTER THE BOARD APPROVES THE APPLICATION AND UPON PAYMENT OF A FEE OF $5, IT SHALL ISSUE TO THE SOLICITOR A PERMIT CARD PERMITTING THE SOLICITATION OF STUDENTS WITHIN THE STATE OF MARYLAND. THE PERMIT SHALL BE ISSUED ONLY ON AN ANNUAL BASIS, EXPIRING ON JUNE 30 OF
EACH YEAR, AND IT MUST BE RENEWED ANNUALLY TO ENTITLE THE
SOLICITOR ENGAGE IN HIS BUSINESS.
(4) FOR A VIOLATION OF THE CONTRACT WITH THE
STUDENT OR FOR OTHER GOOD CAUSE, THE BOARD MAY REVOKE THE PERMIT ISSUED TO ANY SOLICITOR AFTER DUE NOTICE OF THE REVOCATION TO THE SOLICITOR AND AN OPPORTUNITY TO BE HEARD ON THE REVOCATION.
SECTION 4 3. AND BE IT FURTHER ENACTED, That this
Act shall take effect July 1, 1977.
