3130                                    LAWS OF MARYLAND                            Ch. 772 shall take effect July 1, 1977.

CHAPTER 773 (House Bill 488) AN ACT concerning Cremation FOR the purpose of providing for delegation of authority
for identification of a corpse and authorization for
cremation under certain conditions. BY adding to Article 43 - Health Section 367A(d) Annotated Code of Maryland (1971 Replacement Volume and 1976 Supplement) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 367A (d) be and it is hereby
added to Article 43 - Health, of the Annotated Code of
Maryland (1971 Replacement Volume and 1976 Supplement) to
read as follows: Article 43 - Health 367A. (D)        IF THE NEXT-OF-KIN OR ANY PERSON AUTHORIZED TO MAKE CREMATION ARRANGEMENTS IS NOT AVAILABLE EITHER TO
IDENTIFY THE CORPSE OR AUTHORIZE THE CREMATION, THE
AUTHORITY MAY BE DELEGATED TO ANOTHER PERSON FOR
IDENTIFICATION AND A TELEGRAM AUTHORIZING CREMATION MAY
BE FORWARDED BY THE PERSON DELEGATED BY TELEGRAM, BEARING
THAT PERSON'S NAME, ADDRESS, AND RELATIONSHIP TO THE
DECEASED.        WRITTEN AUTHORIZATION SHALL FOLLOW BY MAIL, BUT THE WRITTEN AUTHORIZATION DOES NOT TAKE PRECEDENCE
OVER THE TELEGRAM AUTHORIZING THE IDENTIFICATION AND
CREMATION.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
