MARVIN MANDEL, Governor
§8(o). It has been revised to conform with the
similar provisions of §5-209 of this article,
relating to the State Aviation Administration. In subsection (b)(1) of this section, the
present reference to "affirmations" is deleted
as unnecessary in light of Art. 1, §9 of the
Code. Subsection (b) (2) of this section is taken
from §5-209 (c) (2) of this article and added
here for conformity since this power is
important to the conduct of hearings. In subsection (c)(2) of this section, the
present provision dealing with contempt of
court is deleted as unnecessary since the
court has this power, in any event, without
need for any express statutory statement here.
In this regard, see CJ §1—202(a) and its
revisor's note. 7-211. CONFLICT OF INTERESTS PROHIBITED. (A)      PROHIBITIONS. AN OFFICER OR EMPLOYEE OF THE ADMINISTRATION MAY
NOT: (1)     BE FINANCIALLY INTERESTED, EITHER
DIRECTLY OR INDIRECTLY, IN ANY CONTRACT, SALE, PURCHASE,
LEASE, OR TRANSFER OF PROPERTY TO WHICH THE
ADMINISTRATION IS A PARTY; (2)   IN CONNECTION WITH SERVICES PERFORMED IN
THE SCOPE OF HIS OFFICIAL DUTIES OR EMPLOYMENT, SOLICIT
OR ACCEPT MONEY OR ANY OTHER THING OF VALUE IN ADDITION
TO THE COMPENSATION OR EXPENSES PAID HIM BY THE
ADMINISTRATION; OR (3)    OFFER MONEY OR ANYTHING OF VALUE FOR OR
IN CONSIDERATION OF OBTAINING AN APPOINTMENT, PROMOTION,
OR PRIVILEGE IN HIS OFFICIAL CAPACITY OR EMPLOYMENT WITH
THE ADMINISTRATION. (B)   FORFEITURE OF OFFICE OR EMPLOYMENT. IN THE DISCRETION OF THE ADMINISTRATION, ANY OFFICER
OR EMPLOYEE WHO WILLFULLY VIOLATES ANY PROVISION OF THIS
SECTION FORFEITS HIS OFFICE OR EMPLOYMENT. (C)   CONTRACTS VOIDABLE.
THE ADMINISTRATION MAY VOID ANY CONTRACT MADE IN
VIOLATION OF THIS SECTION.
