19A.
(a) There shall be a Land Acquisition Division
under the Department of General Services. Land for all
public improvements within the meaning of § 20 of this
subtitle, including those State projects funded under the
"Outdoor Recreation Land Loan of 1969" or "Program Open
Space" shall be negotiated exclusively by this Division;
and all State acquisitions shall be made in the name of
the using State agency or in the name of the principal
department of the State government of which the using
agency is a constituent part. The Land Acquisition
Division has no responsibility for local projects or for
developing the acquired land. Development of land
acquired under "Program Open Space" is the responsibility
of the managing State agencies. ANY EXISTING STRUCTURE,
VALUED NOT IN EXCESS OF $1,000, ON PROPERTY ACQUIRED
UNDER THE "PROGRAM OPEN SPACE", MAY BE SOLD BY THE
DEPARTMENT OF GENERAL SERVICES WITHOUT REGARD TO ANY LAW
OR RULE OF COURT. NOTWITHSTANDING THE PROVISIONS OF
SECTION 15 OF THIS ARTICLE, THE DEPARTMENT OF NATURAL
RESOURCES MAY DISPOSE OF ANY EXISTING STRUCTURE, VALUED
NOT IN EXCESS OF $2,500, ON ANY PROPERTY ACQUIRED BY THE
STATE OF MARYLAND FOR THE USE OF THE DEPARTMENT OF
NATURAL RESOURCES. AFTER PUBLIC NOTICE IN ANY NEWSPAPER
OF GENERAL CIRCULATION IN THE COUNTY IN WHICH THE
PROPERTY IS LOCATED. THE PROCEEDS OF THE SALE SHALL BE
PAID TO THE NATURAL RESOURCES PROPERTY MAINTENANCE FUND.
All eminent domain proceedings filed by the State of
Maryland in the name of a director or secretary and now
pending in the courts of the State shall be valid, legal
and effective without the necessity of joining the
Secretary of General Services as a party to each
proceeding.
SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 5—909 be and it is hereby added to Article -
Natural Resources, of the Annotated Code of Maryland
(1974 Volume and 1976 Supplement) to ice read as follows:

5-909.
THE NATURAL RESOURCES PROPERTY MAINTENANCE FUND IS
CREATED WITH IN THE DEPARTMENT TO BE USED FOR THE
MAINTENANCE, REPAIR, AND MANAGEMENT OF PROPERTY OWNED BY
THE DEPARTMENT.

SECTION 2 3. AND BE IT FURTHER ENACTED, That this
Act shall take effect July 1, 1977.
