LAWS OF MARYLAND
under the new subtitle "Day—Care Centers for Medically Handicapped Adults"
Annotated Code of Maryland
(1971 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 717G through 717K 717J,
inclusive, to be under the new subtitle "Day-Care Centers
for Medically Handicapped Adults" be and they are hereby
added to Article 43 - Health, of the Annotated Code of
Maryland (1971 Replacement Volume and 1976 Supplement) to
read as follows: Article 43 - Health DAY-CARE CENTERS FOR MEDICALLY
HANDICAPPED ADULTS 717G. THE PURPOSE OF THIS SUBTITLE IS TO PROVIDE FOR THE
ESTABLISHMENT OF DAY-CARE CENTERS AND SERVICES IN THE
STATE FOR MEDICALLY HANDICAPPED ADULTS THAT WILL GIVE
THESE ADULTS THE CHANCE TO REMAIN WITH THEIR FAMILIES AND
IN THEIR COMMUNITIES, RATHER THAN BEING PLACED IN NURSING
HOMES OR STATE INSTITUTIONS, AND TO ALLOW THE STATE OF
MARYLAND TO DEAL MORE EFFECTIVELY AND ECONOMICALLY WITH
THE NEEDS OF ITS MEDICALLY HANDICAPPED ADULT CITIZENS.
IT IS THE INTENT OF THE GENERAL ASSEMBLY THAT DAY-CARE
CENTERS AND SERVICES FOR MEDICALLY HANDICAPPED ADULTS
SHALL BE UTILIZED: (1) TO THE GREATEST EXTENT POSSIBLE,
AS AN ALTERNATIVE TO THE UNNECESSARY COMMITMENT OF SUCH
PERSONS TO NURSING HOMES, STATE INSTITUTIONS, OR OTHER
LONG-TERM CARE FACILITIES; (2) TO PROVIDE OPPORTUNITIES
FOR SUCH ADULTS IN NURSING HOMES, STATE INSTITUTIONS, OR
GENERAL AND SPECIAL HOSPITALS TO BE DISCHARGED FROM THESE
INSTITUTIONS; AND (3) TO SERVE ONLY THOSE ADULTS WHO
OTHERWISE WOULD BE ELIGIBLE FOR CARE IN NURSING HOMES,
STATE INSTITUTIONS, OR OTHER LONG-TERM CARE FACULTIES
UNDER PRESENT APPLICABLE STATE AND FEDERAL LAW. 717H. (A)    AS USED IN THIS SUBTITLE THE FOLLOWING TERMS
HAVE THE MEANINGS INDICATED: (B)    "DAY-CARE CENTER FOR ADULTS" MEANS A PLACE
OPERATED FOR THE PURPOSE OF PROVIDING CARE FOR ADULTS,
WITH OR WITHOUT CHARGING A FEE, AND INCLUDES A PLACE
DESIGNATED FOR GROUP DAY CARE FOR FOUR OR MORE ADULTS OR
A FAMILY HOME PROVIDING DAY CARE FOR TWO OR THREE ADULTS. (C)    "ADULT" MEANS A PERSON 16 YEARS OF AGE OR
OLDER BUT WHO IS NOT YET 60 YEARS OF AGE WHO EITHER LIVES
ALONE OR WHO LIVES WITH HIS OR HER SPOUSE, RELATIVE, OR
FRIEND, BUT REQUIRES TEMPORARY SUPERVISION AND CARE
DURING A PART OF HIS OR HER DAY.
